The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 379 and 420 of the Indian Penal Code.
The accusation against the petitioner to withdraw money through ATM from the account of the informant by changing PIN number.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case and there is no recovery from the conscious possession of the petitioner. It is further submitted that the name of the petitioner sprang up in the present case merely on suspicion. A statement has been made in paragraph 3 of the petition that the petitioner
Patna High Court CR. MISC. No.73770 of 2022(2) dt.06-02-2023 2/2 is accused in one another case.
Learned APP opposed the prayer for anticipatory bail and submits that from the impugned order it appears that the name of the petitioner sprang up in the present case on the basis of CCTV footage.
Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner and accordingly, this bail application is rejected. However, the learned court below consider the prayer for regular bail of the petitioner without being prejudiced by the order of this Court.
