JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-04-2019 The petitioner apprehends his arrest in connection with NTPC Khaira P.S.Case No. 08 of 2018 registered under Sections 498A of the Indian penal Code.
Allegation against the petitioner, who happens to be the husband, is of subjecting his wife for demand of dowry and on non-fulfillment, she was tortured and also he has illicit relationship with another girl. He also threatened to get another marriage.
Submission of learned counsel for the petitioner is that all allegations levelled are false and concocted and she is actually residing in the house of the petitioner itself and in spite of service of notice, she neither appeared nor anybody appeared on behalf of O.P.No. 2.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with NTPC Khaira P.S.Case No. 08 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further conditions that he will co-operate in disposal of trial and also co-operate in maintenance case, if any, filed by the O.P.No. 2, otherwise O.P.No. 2 is at liberty to move for cancellation of his bail bond.
