JUSTICE RAKESH KUMAR ORAL ORDER 13-02-2018 Heard Sri Chandra Shekhar Anand, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Complaint Case No.355/2017 registered for the offence under Sections 323,509 and 354 of the Indian Penal Code, has prayed for grant of bail, in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that due to the reason that the complainant was prevented by the petitioner from proceeding with the business of milk, on false accusation a complaint petition was filed in the court of learned Chief Judicial Magistrate. By way of referring to the fact disclosed in the complaint petition, learned counsel for the

Patna High Court Cr.Misc. No.6706 of 2018(2) dt.13-02-2018 2/2 petitioner submits that the petitioner has falsely been implicated. Besides hearing learned counsel for the parties, I have also perused the material on record, particularly the fact disclosed in the complaint petition and after going through the same, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail.

Accordingly, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner, namely, Bhuneshwar Jha @ Bhubneshwar Jha be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl.Chief Judicial Magistrate, Muzaffarpur in connection with Complaint Case No.355 of 2017, subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
