JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2018 Petitioner apprehends his arrest in connection with Sahebganj P.S.Case No. 298 of 2017 registered under Sections 406 and 420 of the Indian Penal Code.
Allegation against the petitioner, who happens to be Panchayat Sewak, is that on verification he recommended the name of co-accused with respect to Old Age Pension. Submission of learned counsel for the petitioner is that as a matter of fact he recommended the name of Jaisheela Devi after verification of voters' list. However, Jaisheela Devi has applied for correction her age in the voters' list and after coming to know the same he got the amount deposited by Jaisheela Devi, as such, laches was not intentional.

Having heard both sides and in view of facts and
Patna High Court Cr.Misc. No.12453 of 2018 (2) dt.28-02-2018 2/2 circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-I West, Muzaffarpur, in connection with Sahebganj P.S.Case No. 298 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner shall co-operate in investigation and appear before the Investigating Officer as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
