====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 20-02-2023 Heard learned counsel for the parties concerned. Petitioner retired from the post of Lower Division Clerk on 30.04.2011 from Chapra Municipal Corporation. The petitioner had approached this Court earlier in CWJC No. 1849 of 2014 regarding payment of post retiral dues. According to the learned counsel for the petitioner, some of the retiral dues has been paid, but some grievance of the petitioner still subsists, for which, the petitioner has filed a representation before the Municipal Commissioner, Chapra Municipal Corporation, and the same is still pending.

Patna High Court CWJC No.22001 of 2019(4) dt.20-02-2023 2/3 Mr. Indu Bhushan, learned counsel appearing for the Corporation submits that details of the claim has not been annexed in Annnexure-4/1 of the representation of the petitioner and it would be better if the petitioner filed a fresh representation raising his claim before the Commissioner within a period of four weeks.

Having heard learned counsel for the parties and taking into consideration the nature of dispute, the petitioner is directed to file a fresh representation before the learned Municipal Commissioner, Chapra, within a period of four weeks and if such a representation is filed, the Municipal Commissioner, Chapra, is directed to consider the claim of the petitioner and dispose the representation by speaking and reasoned order in accordance with law within a period of two months from the date of receipt/production of a copy of the representation.

It goes without saying that if any amount is found payable to the petitioner, the same shall be paid by the Municipal Corporation within a period of one month from the date of disposal of the representation filed by the petitioner. With aforesaid observation and direction, this writ
