Petitioner apprehends his arrest in connection with Chakand P.S.Case No. 134 of 2017 registered for the offences punishable under Sections 376 and 511 of the Indian Penal Code and Section 4 of POCSO Act.
Allegation against the petitioner is of attempting to commit rape upon the informant.
Submission of learned counsel for the petitioner is that the parties have settled the dispute and informant in her statement under Section 164 Cr.P.C. has stated that she is living with the petitioner as wife and husband.
Heard learned APP also.
Having heard both sides and no doubt the allegation is
Patna High Court Cr.Misc. No.12980 of 2018 (2) dt.04-04-2018 2/2 serious in nature but in view of Annexure-2 showing that they are living together, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I-cum-Special Judge, POCSO Act, Gaya, in connection with Chakand P.S.Case No. 134 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
