The petitioner is in custody since 28.08.2019 in connection with Balia Belon P.S. Case No. 95/2019 registered for the offence punishable under Sections 380 of the Indian Penal Code.

Learned counsel for the petitioner submits that the alleged recovery of motorcycle was not from his conscious possession, but from a public place. It is further submitted that the petitioner has also been remanded in connection with another case soon thereafter.

Considering the aforementioned facts and circumstances and that there is no cogent material to show that the said motorcycle was recovered from the conscious possession of the petitioner, let the petitioner above named be
