The petitioner apprehends her arrest in Haspura P.S. Case No.216 of 2018 registered under Sections 420 and 34 of the Indian Penal Code.
The informant alleged that informant had talk with Himanshu Kumar Suman and Himanshu Kumar Suman assured to supply goods to the informant on payment of Rs.4,600/- in the account of the petitioner. The informant deposited Rs.4,600/- in the account of the petitioner on 21.08.2018. The informant alleged that no goods was supplied to the informant. Learned counsel for the petitioner submits that petitioner did not assure to supply the goods to the informant.
Patna High Court CR. MISC. No.66374 of 2019(2) dt.22-10-2019 2/2 The petitioner is ready to return Rs.4,600/- which was deposited in the account of the petitioner by the informant. Taking into consideration the facts aforesaid and the fact that petitioner is ready to return the amount within one month, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad in connection with Haspura P.S. Case No.216 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
