The petitioner seeks pre-arrest bail in connection with Azamnagar P.S. Case No. 129 of 2019, registered under Section 302 of the Indian Penal Code.
The accusation is that on 21.06.2019 in the noon, the informant, Anita Uraon, received information about murder of her mother and lying her dead body in the courtyard. Thereafter, she proceeded to her maika, Tahirpur, and came to know from her younger sister, Somu Kumari, that her cousin uncle, Ranjeet Uraon, due to family dispute, gave the spade blow at the head of her mother.
Submission is that occurrence of marpeet took place due to land dispute and it would appear from the first information report that informant is not the eye witness of the
Patna High Court CR. MISC. No.66291 of 2019(3) dt.24-02-2020 2/2 occurrence. The petitioner is in custody since 24.05.2019. On the other hand, the learned Additional Public Prosecutor submits that Somu Kumari, younger sister of the informant and one Sanjiv Kumar, who were present on spot, have specifically stated about giving spade blow by the petitioner at the head of the mother of the informant. Having regard to the facts and circumstances of the case, I am inclined to grant bail to the petitioner. The prayer for bail is rejected.
