2. Learned counsel for the petitioner has submitted that earlier the anticipatory bail application of the petitioner was rejected vide order dated 20.07.2024 passed in Cr. Misc. No.3119 of 2024 by the learned Co-ordinate Bench. It is further submitted that the regular bail application of the petitioner was rejected earlier by this Court vide order dated 03.04.2025 passed in Cr. Misc. No. 76671 of 2024 with a liberty to the petitioner to renew his prayer for bail after six months if the trial is not concluded.
3. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 302, 201 and 120(B)/34 of the Indian Penal Code (in short 'IPC').

Learned counsel for the petitioner has submitted that the short facts giving rise to the case are that the petitioner and others have committed the murder of the husband of the informant along with other co-accused persons. Learned counsel for the petitioner has further submitted that nature of the allegation is general and omnibus. There is no any eye-witness to the present occurrence. Learned counsel for the petitioner has also brought to the notice the order dated 03.04.2025 of this Court vide Cr. Misc. No. 76671 of 2024 wherein it was recorded by this Court in paragraph '5' that "As far as Tirath Singh is concerned, learned counsel for the petitioner has submitted that in this case there is no eye-witness and that prior to occurrence Ashutosh Singh has filed a case that Rahul has threatened him of dire consequence." Petitioner is in custody since 25.09.2024. Learned counsel for the petitioner has also submitted that till today the case has still not been committed to the Court of Session.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named

Case No. 417 of 2023 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai.
7. Accordingly, the present bail application of the petitioner stands allowed.
