This application is for grant of regular bail in connection with Sessions Trial No.361 of 2019 (arising out of Kadamkuan P.S.Case No.364 of 2017) for the offences under Sections 302/120(B) of the Indian Penal Code. As per the prosecution case, the petitioner is said to have killed the son of the informant.

Submission of the learned counsel for the petitioner is that only on suspicion as he demanded Rs.5 lac from the deceased he has been made accused. It is further submitted that though he is accused in six other cases but those cases are of quite old. He is in custody since 19.11.2018. Heard learned A.P.P. , who has opposed the prayer

Patna High Court CR. MISC. No.66268 of 2019(4) dt.05-02-2020 2/2 for bail on the ground that one witness has taken the name of the petitioner as the assailant. Apart from that he is accused in three cases under Section 302 of the IPC as such he does not deserve bail.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner .

With the aforesaid observation, this application is dismissed.
