JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Punpun P.S. Case no. 227 of 2019, registered for the offences punishable under Sections 7 of E.C. Act.
Huge quantity of gas cylinder was recovered from a store room of the petitioner.
Submission on behalf of the petitioner is that petitioner used to deliver the gas cylinder to bonafide customers because the bonafide customers did not like to go to the agency. He further submits that all the relevant documents of bonafide customers were produced not only before the police but also to the learned court below but in spite of that this case has been instituted and the prayer of anticipatory bail of the petitioner has been rejected by the court below.
Considering the facts and circumstances of the case as
Patna High Court CR. MISC. No.71858 of 2019(2) dt.18-12-2019 2/2 well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner, above named, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Masaurhi in connection with Punpun P.S. Case No. 227 of 2019, subject to conditions as laid down under Section 438(2) of the CrPC.
