2. The petitioner seeks bail in a case registered for the offence punishable under Sections 109, 115(2), 126(2), 190(2), 191(2), 303(2), 329, 351(3) and 352 of the B.N.S..
3. As per prosecution case, this petitioner is alleged to have assaulted informant and his wife by means of iron rod. Doctor has found the injuries sustained by the injured to be grievous in nature.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. There are general and omnibus allegations and no
Patna High Court CR. MISC. No.76939 of 2024(6) dt.27-06-2025 2/2 specific accusation of overt act against this petitioner. Chargesheet has already been submitted and petitioner is in custody since 02.09.2024.
5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the nature of accusation and period of custody, the prayer for grant bail of to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate Ist, Nalanda at Biharsharif in connection with Harnaut P.S. Case No. 285 of 2024.
