The petitioners seek anticipatory bail in connection with Obra PS case no. 120 of 2017 registered for the offences punishable under Sections 302, 307, 323, 324, 325, 326, 504, 147, 148 and 149 of the Indian Penal Code.

The case of the prosecution is regarding the accused persons armed with gun, rifle, pistol etc., having arrived at the place of occurrence and thereafter one of the accused persons, namely, Brij Kishore Singh is said to have fired on the brother of the informant resulting in his death.

The learned counsel for the petitioners submits that as far as

It is further submitted that the present case arises out of a case and counter case and the petitioners herein are having a clean antecedent. Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of the present order, the petitioners above named are directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Daudnagar, District Aurangabad, in connection with Obra PS case no. 120 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
