2. The petitioner seeks bail in connection with Patori Excise P.S. Case No. 129 of 2025 registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2018.

3. As per the prosecution case, the police recovered 1528.995 litres of illicit foreign liquor from an underconstruction house.

4. The police arrested on person namely Nand Kumar Singh (petitioner) from the said house.

5. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the

Learned counsel further submits that the house form which the alleged recovery of illicit liquor has been made was a house under construction (uninhabitable). Therefore, the petitioner was not living there. Learned counsel further submits that the due to non-completion of the construction work, this petitioner has no concern with the alleged recovery and nothing has been recovered from this conscious physical possession. Learned counsel further submits that petitioner has two criminal antecedents and he is in custody since 23.09.2025.

6. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

7. Considering the facts and circumstances of the case, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise)-II, Samastipur in connection with Patori Excise P.S. Case No. 129 of 2025 subject to the conditions:- (i) The petitioner will remain physically present till disposal of the case, except in exceptional circumstances preventing physical appearance.
