The petitioner is languishing in custody in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471 of the Indian Penal Code.

It is alleged against the petitioner that he produced forged documents with regard to plot No. 70 under Patliputra Cooperative Society.

The power of attorney and its rectification of power of attorney was executed by Dr. Girish Nandan Prasad in which he has mentioned the name of his father as son of Late S.N.Prasad and said S.N. Prasad is also known as Dr. Sideshwari Nandan Prasad and that is the reason that all his four sons have also the title of Nandan Prasad. There is absolutely nothing to suggest that any document executed in favour of the petitioner i.e. deed of conveyance or rectification of power of attorney is forged save and except the vague imaginary statement given by the informant. Even from the F.I.R, there is no allegation that Dr. Girish Nandan Prasad has made any written complaint that either he has not executed any deed of power of attorney in favour of the petitioner or his signature is forged. The petitioner is languishing in custody since 24.07.2023.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Patliputra P.S. Case No. 58 of 2013.
