====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 22-03-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.
Earlier bail applications of the petitioner were rejected vide Cr. Misc. No. 27034 of 2020 under order dated 07.12.2020 and Cr. Misc. No. 60774 of 2021 under order dated 02.02.2022, annexed as Annexure-1 series to the present application taking into account that the petitioner happens to be one of the assailants. This is third attempt on behalf of the petitioner for grant of bail.
Patna High Court CR. MISC. No.73519 of 2022(3) dt.22-03-2023 2/3 A report was called for from the learned court below regarding the present stage of the case. It has been reported that out of nine charge-sheeted witnesses, six prosecution witnesses have already been examined and the trial is likely to be concluded within a period of six months. Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected in Sessions Trial No. 225 of 2020, arising out of Lauriya P.S. Case No. 142 of 2019, pending in the court of learned 4th Additional Sessions Judge, Bettiah, West Champaran.
Learned court below is directed to take all necessary steps to conclude the trial preferably within a period of four months from the date of receipt/production of a copy of this order.
The District Magistrate and the Superintendent of Police, Bettiah, West Champaran are directed to ensure that the prosecution witnesses are produced on the fixed date in the court below so that the trial could be concluded within the stipulated period.
