Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.
The petitioner seeks regular bail in connection with Dhaka P.S. Case No. 464 of 2022, lodged under Sections 498A/494/323/307/420/120B/34 of the Indian Penal Code read with Section 3/4 of Dowry Prohibition Act.
As per prosecution case, the F.I.R. has been lodged by the wife of petitioner against six named accused persons who are the entire family members. The specific allegation of assault is there against the present petitioner.
Learned counsel for the petitioner submits that there is one criminal case pending against the petitioner, in which, he is on bail. He further submits that the petitioner is in custody since
Patna High Court CR. MISC. No.73713 of 2022(2) dt.25-03-2023 2/2 16.08.2022. It has also been stated by the petitioner that he is ready to abide by the conditions whatsoever shall be imposed upon him by the Court. Learned counsel further submits that petitioner has every respect for his wife and he himself offers payment of Rs.5,000/- per month to the informant.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Dhaka P.S. Case No. 464 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. with further condition on which the parties agreed after discussion with the counsels that petitioner shall pay Rs.5,000/- per month to the informant as maintenance.
With this observation, the bail application stands allowed.
