JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 467, 468, 471, 120(B)/34 of the Indian Penal Code and Sections 30(a), 38, 41 of the Bihar Prohibition and Excise Act, 2016.

In huge quantity, Indian made foreign liquor was recovered from a truck and the driver and Khalasi of the aforesaid truck were apprehended. On being interrogated, the driver of the said truck disclosed that the seized liquor was to be delivered to the petitioner and except the aforesaid material as well as criminal antecedent, there appears to be nothing against

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judgecum-Special Judge, Excise, Gopalganj in connection with Mahammadpur P. S. Case No. 18 of 2019.
