2. The petitioner is in custody since 10.09.2023 in connection with Barachatty P.S. Case No. 91/2015 registered for the offence punishable under Sections 18/20/22 of the NDPS Act.

3. As per the prosecution case, the petitioner is alleged to have been involved in cultivating opium.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that nothing incriminating has been recovered from the possession of the petitioner. He next submits that the land in question does not belong to the petitioner. The petitioner has no criminal antecedents.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge (NDPS), Gaya in connection with Barachatty P.S. Case No. 91/2015.

7. The petitioner is directed to mark his attendance in Barachatty police station on 1st Sunday and last Sunday of every month.
