The petitioner apprehends his arrest in Revilganj P.S. case No. 163 of 2017 for the offences punishable under Section 328, 302/34 of the Indian Penal Code. The informant, mother of the deceased, alleged that she got her daughter married with Baban Choudhary but her daughter was subjected to different sorts of torture by her husband and other in-laws.

The learned counsel for the petitioner submits that petitioner is brother-in-law of the deceased and the marriage was solemnized 10 year ago. The petitioner is living separately and he has got no manner of concern with the family affairs of deceased or her husband. Guriya Devi, sister-in-law of the deceased, has

Patna High Court Cr.Misc. No.8257 of 2018 (2) dt.17-02-2018 2/2 already been granted anticipatory bail vide order passed in Cr. Misc. No. 45505 of 2017.

Taking into consideration the fact that petitioner is brother-in-law of the deceased and there is no specific allegation against him, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Revilganj P.S. case No. 163 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
