Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 353, 332, 427, 504, 379 and other allied sections of Indian Penal Code and Section 56/39(3) of the Bihar Minerals (Concession and Prevention of Illegal Mining, Transportation and Storage) Act, 2019. As per prosecution case, 10 F.I.R. named accused persons including the petitioner and 300 unknown persons are alleged to have illegally stored sand from the bank of River Ganga, causing huge loss to the exchequer.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and without any physical verification of the spot in question, allegations have been

He next submits that similarly situated co-accused namely Pawan Rai has been granted anticipatory bail by co-ordinate Bench of this Court vide order dated 08.08.2022 passed in Cr. Misc. No. 7848 of 2022. Petitioner claims clean antecedent.
Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Gangabridge P. S. Case No. 188 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
