The petitioner seeks bail in connection with Sugauli P.S. Case No. 503 of 2021 instituted for the offence under Sections 406, 420 and 120(B) of the Indian Penal Code. 3.

The FIR instituted on the basis of a written application by the Area Manager, L & T Financial Services, Motihari, alleging fraudulent withdrawal or embezzlement of an amount to the tune of Rs. 4,78,228/-.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 16-09-2023, and have no criminal antecedents. It is submitted that allegation levelled against the petitioner is general and omnibus.

Learned counsel for the petitioner further submits that petitioner has been falsely implicated in this case due to office politics. The petitioner is not named in the F.I.R. Even no witness has come forward to support the prosecution case so far as involvement of the present petitioner in the alleged crime is concerned.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case and period of custody of the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sugauli P.S. Case No. 503 of 2021.
