The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

The prosecution story, in brief, is that the informant who is conducting CSP of ICICI Bank in his village and on 24.1.2022 at 11:00 AM, when he was on medicine shop with withdrew amount of Rs. 2 lakh 60 thousand, in the meantime, two miscreants riding one motorcycle came and snatched his bag containing money. Thereafter, this case has been lodged. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner was arrested in Hajipur Town P.S. Case No. 151 of 2022 and he made confessional statement before the police and

Patna High Court CR. MISC. No.73752 of 2022(2) dt.21-03-2023 2/2 on basis of which, he has falsely been implicated in the present case. Neither the petitioner is named in FIR nor any incriminating article has been recovered from his conscious possession which shows his complicity in the alleged offence. It is further alleged that the petitioner has not put on TI Parade till now. Moreover, he is languishing in judicial custody since 12.5.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Hajipur Town P.S. Case No. 64 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
