====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 28-03-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 188, 353, 409 of the Indian Penal Code.

The prosecution story, in brief, is that folder and documents regarding to the employment of Siksha Mitra and Panchayat Teacher was to be produced before the Vigilance Investigation Bureau but the same could not be produced to him.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No such occurrence as alleged ever took place. He has been falsely implicated in this case. It is further submitted that when the petitioner was promoted as a Block Agriculture Officer, he had

No.74672 of 2022(2) dt.28-03-2023 2/2 given his charge and all concerned documents to Suresh Prasad, Panchayat Secretary, Samharigarh on 10.09.2007 and joined at Hilsa as a Block Agriculture officer. He further submits that similarly situated co-accused has been granted bail by the Co-ordinate Bench of this Court in Cr. Misc. No. 66556 of 2021 vide order dated 18.07.2022. Petitioner has no criminal antecedent as mentioned in para-3 of this application. Learned APP for the State opposed the prayer for bail.

Having regard to the facts and circumstances of the case, as the similarly situated co-accused has been granted bail by the co-ordinate Bench of this Court, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Roh P.S. Case No. 08 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
