The petitioner is apprehending his arrest in connection with Supaul P.s.Case nO.136 of 2018 registered for offences punishable under Sections 366(A)/34 of the Indian Penal Code. At the very outset it is submitted on behalf of the State that already the process under Sections 82 and 83 of the Cr.P.C. has already been taken against the petitioner, as such this application is not maintainable.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which
Patna High Court Cr.Misc. No.39826 of 2018 (3) dt.27-07-2018 2/2 will be considered by the learned court below on its own merit without being prejudiced by the order of this Court, if possible on the same day.
