The petitioner seeks bail in a case registered under Sections 395, 397 of the Indian Penal Code and 4/5 of Explosive Substance Act.

Allegation is that the accused persons along with five unknown miscreants on the point of pistol looted Rs.1 lakh cash and gold jewellary from the shop of the informant and they also exploded bomb.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.08.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional

Patna High Court CR. MISC. No.66745 of 2019(2) dt.22-10-2019 2/2 statement of co-accused. There is no recovery of any incriminating article from the petitioner. The petitioner has not been put on T.I.P.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Daudnagar, Aurangabad in connection with Haspura P.S. case No.79 of 2018.
