The petitioner seeks bail in a case registered for the offence punishable under Sections 25(1-b)a/26/35 of the Arms Act and 4/5 of the Explosive Substance Act.

Learned counsel for the petitioner submits that the name of the petitioner has come in the present case on the confessional statement of co-accused Raushan Kumar. There is no recovery from the conscious possession of the petitioner. It is further submitted that the co-accused Raushan Kumar has been granted the privilege of bail by coordinate Bench of this Court vide order dated 26.10.2018 in Cr. Misc. No. 63378. Petitioner has one criminal antecedent of different nature as stated in para3 of the bail petition and he is languishing in judicial custody

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Daudnagar Police Station Case No. 144 of 2018.
