2. The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 323, 324, 325, 307, 379, 504 and 506 of the Indian Penal Code.
3. Allegation against the petitioners along with other co-accused persons is that they assaulted the informant along with his family members due to which they sustained injuries.
4. Learned counsel for the petitioners submits that the petitioners are innocent and has committed no offence. They have falsely been implicated in this case. It is further submitted

No.75973 of 2023(2) dt.30-11-2023 2/2 that both the petitioners who assaulted two persons, namely, Gautam Kumar and Alok Kumar and the injuries of both the injured persons are simple in nature. A statement has been made in para-3 of this petition that the petitioners have got no criminal antecedent. Moreover, they are languishing in judicial custody since 25.08.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioners, this court is inclined to enlarge the petitioner on bail. The above named petitioners are directed to be released on bail in connection with Akbarpur P.S. Case No. 397 of 2023 each of them on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada.
