Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.
The petitioner seeks regular bail in connection with Sessions Trial No. 940 of 2022 arising out of Digha P.S. Case No. 679 of 2019, lodged under Sections 447, 341, 307, 504, 506 & 34 of the Indian Penal Code read with Section 27 of Arms Act. As per prosecution case, the F.I.R. has been lodged against 6 named persons including the present petitioner. In the F.I.R., it has been alleged that all the accused persons in the night have surrounded the informant duly armed and fired on the informant, which injured him in his leg. The passerby had admitted the informant in the hospital, thereafter this case has been filed.
Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.73455 of 2022(2) dt.25-03-2023 2/2 antecedent of petitioner is clean and he is in custody since 19.05.2022. He further submits that the trial has also been commenced after framing of charge. He also submits that there is allegation of one gun shot injury only at the leg. Learned counsel for the petitioner further submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him. Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-16, Patna in connection with Sessions Trial No. 940 of 2022 arising out of Digha P.S. Case No. 679 of 2019, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
