Earlier, the regular bail application of petitioner was rejected vide order dated 28.04.2022 passed in Cr. Misc. No. 71274 of 2021.

Learned counsel for the petitioner submits that earlier, the prayer for regular bail of the petitioner was rejected on the basis of the wrong submission made by learned counsel for the State that this petitioner has been named by the victim in the statement recorded under Section 164 of Cr.P.C. Whereas, perusal of the statement recorded by the victim under Section 164 of Cr.P.C goes to show that the victim has not named this petitioner as one of the culprits. The petitioner is in custody since 24.07.2020.

No.73590 of 2022(3) dt.22-02-2023 2/2 Considering the aforesaid facts and period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-VII cum Special Judge POCSO (SC? ST) Act, Rohtas at Sasaram in Rohtas P. S. Case No. 124 of 2020.
