Petitioners apprehend their arrest in connection with Complaint Case No. 1416 of 2017 lodged for the offences punishable under Sections 406/34 of the Indian Penal Code. Allegation as per complaint petition is that the complainant gave Rs.2 lakhs to petitioner No.1 on the condition that he will return the same after working in her brick kiln as bonded labour and petitioner No.2 is guarantor to that but neither they have worked in her brick kiln nor money has been returned. Submission of learned counsel for the petitioners is that no money has been given to the petitioners and the present

Patna High Court Cr.Misc. No.49460 of 2018 (2) dt.29-08-2018 2/2 complaint is counter blast of complaint case no. 1396 of 2017 filed by petitioner No.1 against the husband of the complainant for kidnapping of son of petitioner No.1, as such petitioners have falsely been implicated in this case.

Having heard both sides and in the facts and circumstances, let the petitioners, named above, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri Deepak Kumar, Judicial Magistrate, 1st Class, Nawada, in connection with Complaint Case No. 1416 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
