This is an application for grant of anticipatory bail in connection with Barhat P.S. Case No. 94 of 2017 registered for the offences punishable under Sections 364(A), 511/34 of the Indian Penal Code, Sections 3 /4 of the Explosives Substances Act, 1908 and Section 27 of the Arms Act, 1959. According to prosecution, five unknown miscreants intruded into the house of the informant and exploded bomb, whereafter, they kidnapped the informant and took him away on motorcycle, however, after going for some distance, the informant had made some commotion resulting in the motorcycle having tumbled, whereafter, the informant had fled away, however, the accused persons were apprehended

Patna High Court Cr.Misc. No.51626 of 2018(2) dt.08-10-2018 2/3 by the police. The said Dharmendra Kumar Tanti, who was apprehended by the local people, had disclosed the name of the petitioner as the person, who had harboured the accused persons.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and moreover, the said Dharmendra Kumar Tanti, who is said to have disclosed the name of the petitioner before the police through his confession, has already been granted bail by this Court by an order dated 19.03.2018 passed in Criminal Miscellaneous No. 10090 of 2018. The petitioner is said to be having one case pending against him, however, it is submitted that the petitioner is on bail in the said case. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. First Class, Jamui in connection with Barhat P.S. Case No. 94 of 2017, subject to the conditions as laid down under Section 438(2) of
