The petitioner apprehends his arrest in connection with Maker P.S. Case No.211 of 2022, registered for the offences punishable under Sections 147, 224, 225 and 353 of the Indian Penal Code as well as under Sections 30(a), 38 and 45 of the Bihar Prohibition and Excise Act.

200 litres of country made liquor has been recovered from the house of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got one criminal antecedent of similar nature. It is further submitted that the house belongs to joint family property.

Learned APP for the State opposes the prayer for

Patna High Court CR. MISC. No.73460 of 2022(3) dt.17-02-2023 2/2 grant of anticipatory bail to the petitioner by submitting that the said illicit liquor has been recovered from the house of the petitioner.

Considering the fact that 200 litres of country made liquor has been recovered from the house of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the petitioner is hereby rejected in connection with Maker P.S. Case No.211 of 2022, pending in the court of learned A.D.J.-X-cumSpecial Judge. (Anjani Kumar Sharan, J) S.KUMAR/- U T
