Earlier the prayer for bail of the petitioner was rejected twice by this Court, firstly vide order dated 7.7.2017 passed in Cr. Misc. No.22406 of 2017 and again vide order dated 4.4.2018 passed in Cr. Misc. No.13520 of 2018 and lastly vide order dated 16.1.2019 passed in Cr. Misc. No.74162 of 2018 .

Submission of the learned counsel for the petitioner is that other co-accused persons have been granted bail by a Co-ordinate Bench of this Court having similar allegation vide order dated 15.12.2017 passed in Cr. Misc. No.55730 of 2017 and he is in custody for about three years. . Heard learned A.P.P. also.

No.67473 of 2019(2) dt.23-10-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Addl. District and Sessions Judge, Siwan in connection with Mairwa P.S.Case No.189 of 2014 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid direction, this application is allowed.
