The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 304B, 201, 34 of the Indian Penal Code.

As per prosecution case, informant alleged that his daughter was tortured and murdered by petitioner and his family members due to non-fulfillment of dowry demand Rs. Two lakh and a motorcycle.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Petitioner is mother-in-law of the victim due to which she has falsely been implicated in this case. The petitioner has no concern mess and business of the deceased as well as her husband and she lives

Patna High Court CR. MISC. No.74204 of 2022(2) dt.23-02-2023 2/2 separately from them. From perusal of the FIR, it is evident that there is no specific overt-act against the petitioner. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. Moreover, petitioner is languishing in judicial custody since 23.09.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Deoria (Deoriya, Deoaria) P.S. Case No. 114 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class (West), Muzaffarpur.
