JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, some co-accused persons were arrested and the said co-accused persons made their confessional statement disclosing the name of the petitioner. Subsequently, petitioner was also arrested and his house was raided from where one motorcycle and one mobile phone was recovered but admittedly, the aforesaid motorcycle as well as mobile phone are not looted property. Moreover, petitioner does not have any criminal antecedent and, up till now, he has not

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the petitioner is in jail custody since 07.08.2019, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Buxar in connection with Itarhi P. S. Case No. 202 of 2019.
