2. The petitioner is in custody in connection with Sonpur P.S Case No. 81 of 2021 registered for the offences punishable under Sections 20/21 NDPS Act.
3. As per prosecution case, total 160 mg. of smack and 19.930 gms. Of Ganja were recovered from the petitioner.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that Co-accused have already granted bail by the Co-ordinate Benches of this Court in Cr. Misc. No.
Patna High Court CR. MISC. No.74748 of 2025(2) dt.19-11-2025 2/3 30968 of 2021, Cr. Misc. No. 36513 of 2021 and Cr. Misc. No. 65179 of 2022. It is also submitted that petitioner is in judicial custody since 04.07.2025.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR and impugned order, it appears that petitioner is not named in FIR and his name transpired from the co-accused, namely, Bacha Rai who has already granted bail by the Co-ordinate Bench of this Court. Co-accused have already granted bail by the Co-ordinate Benches of this Court in Cr. Misc. No. 30968 of 2021, Cr. Misc. No. 36513 of 2021 and Cr. Misc. No. 65179 of 2022.
7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum- Special Judge, Saran in connection with Sonpur P.S Case No. 81 of 2021, subject to condition that the petitioner shall present himself before the police/Court, as the case may be, as and when
