The petitioners have filed the instant application for grant of bail in a case registered for the offence under sections 273 and 34 of the Indian Penal Code and section 30(a) of the Bihar Excise and Prohibition Act, 2016.

As per the allegation in the FIR, 18 litres and 28 litres of IMFL respectively is said to have been recovered from petitioner nos. 1 and 2.

It is submitted by learned counsel for the petitioners that the petitioners have no criminal antecedent, they are in custody since 22.08.2019 and charge sheet has already been submitted

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the above stated facts, the Court is inclined to enlarge the petitioners on bail. Let the petitioners above named be enlarged on bail on each of them furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna in connection with Special Case No. 7516 of 2019 (arising out of Pandarakh Rail P.S. Case 469 of 2019 (District Patna)).
