2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 394 of the Indian Penal Code.
3. The case of the prosecution is that the informant was going on splendor bike of his master, four persons on two bikes stopped him, assaulted him and on the gun point, snatched Rs. 3,000/-, mobile and the bike. The case was lodged against unknown miscreants. One Dilkhush was apprehended and he has disclosed the name of this petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted that the
Patna High Court CR. MISC. No.76538 of 2024(3) dt.23-01-2025 2/2 bike was recovered from the possession of Vidyanand and he has disclosed that he has purchased this bike from Dilkhush Kumar. It is further submitted that the petitioner is languishing in judicial custody since 05.09.2024.
5. Mr. Gauri Shankar Gupta, learned APP appearing for the state has opposed the prayer of regular bail and submits that the petitioner is having criminal antecedent of one case.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Baheri P.S. Case No. 83 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Darbhanga.
