2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 25(1-b) a/26 of the Arms Act and Sections 8, 20 and 22 of the N.D.P.S. Act.
3. The case of the prosecution is that from the possession of this petitioner altogether 1.4 kg of charas like narcotics substance along with one country made pistol and 2 live cartridges were recovered.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted he is not disputing that the recovery of charas from the possession of this petitioner is commercial quantity but since he is languishing in judicial
Patna High Court CR. MISC. No.76952 of 2024(4) dt.25-02-2025 2/2 custody since 10.09.2020, his personal liberty has to be taken into consideration. The petitioner has got five criminal antecedents but none of similar nature.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as the custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Paharpur P.S. Case No. 349 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, East Champaran, Motihari.
