No. 1/2022 alongwith appeal For consideration of the interim application which is for releasing the appellant on bail on medical ground, this court had directed the learned APP to call for report in respect of health condition of the appellant Subuk Lal Singh. Today the learned APP has placed on record photocopy of the report of the Superintendent of Sahid Jubba Sahni, Central Prison, Bhagalpur dated 05.10.2022. That report is marked as Ext. 'X' for the purpose of identification. It is reported by the Superintendent of the Central Prison, Bhagalpur that appellant Subuk Lal Singh aged about 85 years had passed away at 2:43 P.M. on 05.10.2022 while taking treatment at

Patna High Court CR. APP (DB) No.1259 of 2019(9) dt.10-11-2022 2/2 Jawaharlal Nehru Medical College Hospital, Bhagalpur. As the appellant is reported to be dead by the Superintendent of Central Prison, Bhagalpur vide communication as Ext. 'X', the interim application does not survive. The same is accordingly disposed of.

In view of the death of the appellant, the appeal itself stands abated and is consigned to record.
