The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 148, 149, 302 of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted by learned counsel for the petitioner that petitioner was all along on bail in connection with the present case but due to default, his bail bond was cancelled on 24.03.2009 and he was

Patna High Court CR. MISC. No.3969 of 2023(6) dt.28-08-2023 2/3 declared absconder. The petitioner was arrested in another case on 17.11.2020 and in this case the petitioner was remanded on 01.10.2021.

Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner and submitted that bail bonds of the petitioner was cancelled on 24.03.2009 he was declared absconder by the Court below. The petitioner did not appear before the Trial Court due to which the trial got hampered. It appears that vide order dated 28.06.2023, a report with regard to the present stage of the trial was called for. The report of learned Additional District & Sessions Judge-X, Bhagalpur dated 07.08.2023 is at Flag-A which suggests that trial will be concluded within a period of three months.

Considering the fact that petitioner has misused the privilege of bail, this Court is not inclined to grant privilege of bail to the petitioner. The prayer for bail of the petitioner stands rejected.
