2. The petitioner apprehends his arrest in a case registered for the offence under Section 366-A of the Indian Penal Code.
3. As per the prosecution case, this petitioner is also alleged to be involved in the kidnapping of minor daughter of the informant.
4. It is submitted on behalf of petitioner that specific accusation of kidnapping is against co-accused Sahil Yadav and this petitioner has been made accused in this case merely because he happens to be relative of co-accused Sahil Yadav. It is further submitted that from bare perusal of F.I.R., it is apparent that there is love-affairs between co-accused Sahil Yadav and the victim girl and the victim herself left her house on the alleged call of co-accused Sahil Yadav and as such, no offence under Section 366-A of I.P.C. is made out against this

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - III, Munger in connection with Tarapur P.S. Case No. 53 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
