JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-01-2019 The petitioner apprehends his arrest in connection with Bachhwara P.S.Case No. 141 of 2018 registered under Sections 30 and 32 of the Bihar Prohibition and Excise Act, 2016. Allegation as per FIR is of recovery of 26.28 litres of wine from the house of the petitioners and they are accused in some other cases.

Submission of learned counsel for the petitioners is that seizure list itself shows that recovery is made from the bushes and petitioners have not accused in such type of case rather of different type of cases.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners abovenamed,

Patna High Court Cr.Misc. No.78070 of 2018(2) dt.04-01-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Begusarai in connection with Bachhwara P.S. Case No. 141 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
