JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Danapur P.S. Case No. 637 of 2019, registered for the offences punishable under Section 30 (a) of Bihar Prohibition and Excise Act 2016.

As per F.I.R there was recovery of 580.875 liters of foreign liquor from the field behind the house of one Sanjeet Saw and one persons arrested by the police who disclosed the name of the petitioner who succeeded in fleeing away. Submission of the learned counsel for the petitioner is that there is absolutely no allegation against the petitioner, petitioner has no concern with the field, even no specific allegation has been attributed as to how he is involved in this case. He has no criminal antecedent.

Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise, Patna, in connection with Danapur P.S. Case No.-637 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
