The petitioner, who is in custody since 05.09.2019 and has clean antecedent, seeks bail in connection with Rail Gaya P.S. Case No. 346 of 2019 dated 04.09.2019 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

20 litres of liquor is said to have been recovered from a trolley bag which was being carried by the petitioner.

Learned counsel for the petitioner has submitted that the recovery has been shown only on paper and he has been arrested malafidely.

Regard being had to the nature of accusation

Patna High Court CR. MISC. No.71662 of 2019(2) dt.04-12-2019 2/2 against the petitioner and the period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Gaya in connection with Rail Gaya P.S. Case No. 346 of 2019.
