The petitioner seeks bail in a case registered under Sections 379, 411/34 of the Indian Penal Code. Allegation is that the petitioner was caught red handed while he was fleeing away along with stolen crompton motor. It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.08.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The offence is triable by the Magistrate. It is further submitted that the petitioner may be released on bail after completion of three months in custody from 23.08.2019.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after completion of three months in custody from 23.08.2019 on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XI, Gopalganj in connection with Gopalpur P.S. case No.158 of 2019.
