JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 This application, for grant of anticipatory bail, arises out of Gaunaha P.S. Case No. 83 of 2018, disclosing offences under Sections 341, 323, 376, 504 and 506 of the Indian Penal Code and Section 4 of the Protection of Children from Sexual Offences, Act.

Allegation as per F.I.R. is that co-accused committed rape upon the minor daughter of informant and when they went to make complain about the same, this petitioner said to have assaulted the informant.

Submission of learned counsel for the petitioners is that they have been made accused only because they happens to

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge -cum-Special Judge, POCSO Act, West Champaran, Bettiah, in connection with Gaunaha P.S.
