ABHISHEK REDDY ORAL ORDER 17-12-2024 Pursuant to the order dated 19.11.2024, learned counsel appearing on behalf of the respondenrts-Bank has placed on record the letter dated 25.11.2024 written by the Punjab National Bank, wherein it is stated that the petitioner is due an amount of Rs.21,75,849.32/- as of 25.11.2024 and that in case the petitioner pays the entire amount, the officials are ready to cancel the auction.

2. Learned counsel appearing on behalf of the petitioner states that the petitioner is willing to pay the entire amount of Rs.21,75,849.32/- provided sufficient time is granted to the petitioner.

3. Having regard to the above made submission, the

Patna High Court CWJC No.18358 of 2022(9) dt.17-12-2024 2/2 present writ petition is disposed of directing the petitioner to deposit an amount of Rs.12,00,000/- within a period of one month from today and the balance amount of Rs. 9,75,849.32 within a period of two months thereof. In case the petitioner does not deposit the amount as directed by this Court, the respondents-Bank is free to take necessary action in accordance with law. In case the petitioner pays the entire amount, the sale certificate issued in favour of the auction purchaser shall be deemed to have been cancelled. Once the petitioner pays the first installment of Rs. 12,00,000/-, the respondent-Bank shall refund the auction purchaser the amount he has deposited along with the interest @ 7.20% per annum.

4. Once the entire due amount is paid, the respondents-Bank shall issue "No Dues Certificate" to the petitioner.

5. With the above directions, the present writ petition stands disposed of.
